What Phil Crowley Can Say in an Interview:

Data privacy deals with the ownership and restrictions on the use of data acquired from others. It also deals with the processes and procedures needed to maintain the privacy of that data. Data security deals with the  details of protecting data from unauthorized disclosure or use.

The Differences Between
Data Privacy and Data Security

Data Privacy

  • Ownership of data
  • Permitted uses of data
  • Required processes and procedures for managing data
  • Procedures for notification if standards are not met
  • Adherence to legal and regulatory requirements

Data Security

  • Preventing unauthorized access to and copying of data
  • Protecting data and systems from destruction or “lock-up” (e.g., ransomware)
  • Generally, adherence to industry best practices

A business may need different vendors to deal with each set of issues. Data privacy is a legal/regulatory regime that requires at least some input from lawyers and regulatory specialists.  Data security is primarily the domain of the IT experts. In both cases, however, businesses will want to discuss with their insurance professionals what types of coverages are needed to protect them in both cases.
